Ada Community Terms of Service and Privacy Policy
Welcome to the Ada Support Inc. (“Ada”, “our”, “us” or “we”) Ada Community, an online forum for our customers and partners to share ideas, expertise and make connections with other automation experts and thought leaders.
The Ada Community is hosted by a third-party service provider called InSided. By creating an account or otherwise using the Ada Community, you acknowledge that you must agree to, and be bound by, any InSided terms or policies, including InSided’s Terms & Conditions, Privacy Policy and Cookie Policy.By using the Ada Community you (“you,” “your”), are agreeing to abide by these Community Terms of Use, as well as Ada’s Terms of Service and Privacy Policy (collectively, the “Terms”), each of which are incorporated by reference herein and each of which may be amended by us at any time with or without notice to you. To the extent of any consistency between these Community Terms of Service and Ada’s Terms of Service, these Community Terms of Service shall prevail. We recommend you periodically review the Terms as your continued use of the Community indicates acceptance of the latest version of each. Any references in the Terms to Ada’s services or Services shall include the Ada Community.
1. Your Account
A. In order to access the Ada Community, you must create an account by following the instructions on the Ada Community registration page. You must have your own username and password and you are responsible for ensuring that your password remains confidential. You must not share your username or password with anyone, including your colleagues, teammates, or other company employees.
B. You may not use a username that: (i) belongs to someone else, (ii) impersonates another person, (iii) is misleading, (iv) violates any intellectual property or other proprietary rights, (v) is vulgar or offensive, or (vi) that we reject at our sole discretion.
C. You must be 18 years of age or older or at least the age of majority in the jurisdiction where you reside or from which you use the Ada Community in order to access the Ada Community.
D. All information you provide in your profile must be accurate, complete, and true. Ada may delete your account or any content submitted if any of your profile information is inaccurate, false, out of date, or incomplete.
E. If your username or password is compromised, if you become aware of any unauthorized use of your account, or if you notice another breach of security, you must notify us immediately by contacting us at community@ada.support.
2. Your Conduct
Users may use the Ada Community to upload, download, or share material, including words, images, and videos (“Content”) with other users. Your use of the Ada Community, including any Ada Content you share must comply with all applicable laws in the jurisdiction in which you register for and use the Ada Community.
You are solely responsible for your Content. You must not upload Content that:
a. is in violation of the Terms; b. is abusive, threatening, defamatory, bigoted, racially offensive, vulgar, hateful, fraudulent, confidential, or that discloses a person’s private or personal matters without their consent; c. is spam, or make duplicate posts, or post excessively on one or more boards; d. impersonates another person or organization; e. indicates that you are a moderator or otherwise represent Ada; f. promotes illegal activity or discusses illegal activities with the intent to commit them; g. infringes a third party's intellectual property rights or that you otherwise do not have the rights to publish; h. contains advertising, promotional materials, market research or other forms of solicitation, including chain letters and pyramid schemes; i. contains viruses or corrupted files or attempts to exploit a vulnerability of the Community or of another user’s device; j. are designed to evade profanity or other content filters; or k. contains the personal information of another person (such as phone numbers, address, personal email address, social security/insurance number, medical information, or banking information). C. Ada has no obligation to, and does not monitor, the Content shared by Community users. However, Ada may, with or without notice, remove or modify any Content in our sole discretion, including any Content that violates the Terms. D. If you violate the Terms, in our sole discretion, Ada may immediately suspend or terminate your account. You must not, and must not attempt to, evade bans or suspensions or otherwise disregard the directions of Community moderators or administrators. E. If you encounter any Content that violates the Terms, you may report such Content to us by using the “Report” feature in the menu (three dots) of the post.3. Community Content
The use of the Community is at your own risk. The Community is provided on an “as is” and “as available” basis and Ada makes no representation, warranty or condition, express or implied, as to the quality, content, availability or fitness for a specific purpose of the Community or any Content in the Community.
Any user may share Content with the Community. Ada makes no representations, warranties or conditions as to the accuracy, completeness, or truth of any Content posted on the Community and is not liable for any Content contained in the Community. For official support related to Ada’s services, please contact hello@ada.support.
Ada is not liable for any links to third-party sites or content posted in the Community.
You may use the Community to provide Ada with comments, ideas, suggestions, techniques, concepts, questions, or answers related to Ada, our business or our services (“Feedback”). You hereby assign to Ada all intellectual property rights in any Feedback you share with us by using the Community and waive any claim you may have to any form of compensation related to or arising from your Feedback.
Ada respects the intellectual property rights of others, and we ask our Ada Community users to do the same. We may, in our sole discretion, suspend the access or terminate the accounts of users who violate others' intellectual property rights. If you believe that your work has been copied and shared in the Community in a way that constitutes infringement of intellectual property rights, please contact us at the contact information below.
Indemnity and Limitation of Liability
A. You will indemnify, defend and hold us harmless, at your expense, against any third-party claim, suit, action, or proceeding (each, a “Claim”) brought against Ada (and our officers, directors, employees, agents, service providers, licensors, and affiliates) by a third party to the extent that such Action is based upon or arises out of (i) your use of the Ada Community, (ii) your disclosure or solicitation of personal information, (iii) any use of personal information that you disclosed, whether this use is by you or a third party, (iv) your noncompliance with or breach of this Agreement, or (v) your use of third-party products or websites. Ada will notify you in writing within thirty (30) days of our becoming aware of any such claim; give you sole control of the defense or settlement of such a claim; and provide you (at your expense) with any and all information and assistance reasonably requested by you to handle the defense or settlement of the claim, provided you shall not accept any settlement that (a) imposes an obligation on us; (b) requires us to make an admission; or (c) imposes liability not covered by these indemnifications or places restrictions on us without our prior written consent.
B. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ADA SUPPORT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR BUSINESS OPPORTUNITIES. IF, NOTWITHSTANDING THE OTHER TERMS OF THIS AGREEMENT, WE ARE DETERMINED TO HAVE ANY LIABILITY TO YOU OR ANY THIRD PARTY, THE PARTIES AGREE THAT OUR AGGREGATE LIABILITY WILL BE LIMITED TO FIVE HUNDRED DOLLARS.
